Welcome to Thinkies! These Terms of Service ("Terms") explain how you can use the Thinkies mobile application (the "App"). These Terms outline how Thinkies works, what we ask of you, and how we aim to support a safe, trusted experience.

By using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.

1. Who We Are

These Terms are an agreement between you and Miura cc LLC ("Thinkies," "we," "us," or "our"). They apply to all use of the Thinkies mobile app.

Thinkies offers personalised wellness suggestions based on the items you scan and the goals you choose to share. Thinkies does not provide medical, psychological, financial, or professional advice.

2. Eligibility

To use Thinkies, you must be 16 years or older. By using the App, you confirm that this is true.

You're responsible for making sure any information you share with us—such as your wellness goals or things you want to avoid—is accurate.

3. How Thinkies Helps You

Thinkies supports your wellness journey by:

• analysing the items you scan or photograph;
• considering the goals and preferences you choose to share; and
• generating personalised suggestions using AI.

You may also enjoy additional features like conversational guidance, item insights, and subscription-based access.

These recommendations are always meant for general wellness support, not for medical decisions.

4. Wellness & Non-Medical Disclaimer

Thinkies is here to support your wellbeing—but it is not a substitute for professional help. The App does not:

• diagnose, treat, or prevent medical conditions;
• provide medical, nutritional, psychological, legal, financial, or professional advice;
• replace the expertise of qualified professionals.

If you have questions about your health or wellbeing, please consult a trusted professional.

5. Account Registration & Supertab Sign-In

Some features may require an account in a future version of the App.

We may suspend or terminate your account if these Terms are violated.

6. Payments, Subscriptions & Billing

Some Thinkies features require payment.

Payments are handled securely by Apple through the App Store's In-App Purchase system. Thinkies never sees or stores your payment card details.

Pricing

Prices appear in the App and may be shown in your local currency.

Subscription Plan

Thinkies is available as a monthly auto-renewing subscription. A 7-day free trial is offered to new subscribers. After the free trial period ends, your subscription will automatically renew at the standard monthly rate unless cancelled at least 24 hours before the end of the trial or current billing period.

Billing Authorization

When you start a paid plan, payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time in your Apple ID account settings.

Bank or Transaction Fees

Your bank or payment provider may apply additional charges (such as currency conversion or foreign transaction fees). These are your responsibility.

Cancellations & Refunds

Subscriptions renew automatically unless cancelled before the renewal date. Refunds follow the rules of the App Store/Play Store and local laws.

7. Your Responsibilities

To keep Thinkies helpful and safe for everyone, you agree to:

• use the App only for personal, non-commercial purposes;
• provide accurate information;
• follow applicable laws;
• avoid using Thinkies for medical, diagnostic, financial, or clinical decisions;
• avoid disrupting or misusing the App.

8. Acceptable Use

Please do not:

• upload harmful, unlawful, or infringing content;
• use the App for deceptive or abusive purposes;
• reverse-engineer or tamper with the App or its AI systems;
• try to bypass usage limits or payment requirements.

We may suspend or terminate access if these rules are violated.

9. AI-Generated Content & Its Limits

Thinkies uses AI to analyse scanned items and your shared preferences. AI is powerful, but it has limits.

You acknowledge that:

• AI suggestions may sometimes be incomplete or inaccurate;
• outputs are automated and not reviewed by humans;
• suggestions should not be used for medical, clinical, financial, or safety-critical decisions.

Thinkies is not responsible for outcomes or decisions based on AI-generated content.

10. Intellectual Property

All rights to the App—including its design, features, software, and content—belong to Thinkies or our partners.

You receive a limited, personal, non-transferable license to use the App. Nothing in these Terms transfers ownership.

11. Your Content

You own the content you upload (like images or text).

By using the App, you grant Thinkies a limited, non-exclusive license to process your content only to operate and improve the App.

We never use your content for unrelated purposes.

12. Ending Your Use of Thinkies

You may delete your account or stop using the App at any time.

We may suspend or terminate access if:

• you violate these Terms,
• you misuse the App,
• or we discontinue the App.

After termination, some features will stop working immediately.

13. Warranty Disclaimer

Thinkies is provided "as is" and "as available."

We don't guarantee:

• perfect accuracy of AI suggestions;
• uninterrupted or error-free access;
• compatibility with your device or network.

14. Limitation of Liability

To the fullest extent permitted by law:

• Thinkies is not responsible for indirect, incidental, or consequential damages;
• we are not liable for decisions made based on AI suggestions;
• our total liability for any claim is limited to the amount you paid in the 12 months before the claim.

Some regions do not allow certain limitations—your rights may vary.

15. Indemnification

You agree to indemnify and hold harmless Thinkies, its partners, service providers, officers, employees, and contractors from any claims, losses, or expenses (including legal fees) arising from:

• your use of the App,
• your violation of these Terms,
• misuse of AI-generated content,
• or content you upload or share.

This obligation continues after your account ends.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of Switzerland.

Any disputes will be resolved exclusively in the courts of Zug, Switzerland.

17. Changes to These Terms

We may update these Terms occasionally. When we do, we'll update the "Last updated" date.

If you continue using the App after updates, you accept the revised Terms.
